Professor Zhang Xiang of Renmin University of China Came to HNUC to Give a Lecture

On October 8, Professor Zhang Xiang, outstanding young talent of Ten Thousand Talents Plan by the Organization Department of the Central Committee of the CPC, top ten excellent young jurists in China, and deputy dean and doctoral supervisor of Renmin University of China, gave a lecture entitled “Methods of Studying Laws” in F101 of Lezhi Building. The lecture was hosted by Professor Liu Qixiang, dean of School of Laws and Public Administration. More than 150 teachers and students from our school attended and listened to the lecture.

Professor Zhang Xiang mainly, with the theme of “Methods of Studying Laws”, talked from five aspects: the relationship between government by law and laws, dogmatics of laws, the two systems that should be clarified in studying laws, how to study laws, and laws students should have broad vision. At the beginning of the lecture, he proposed that the goal of studying laws is “government by law”, which determines the research and studying methods of laws. Unlike rule by man, the basic meaning of government by laws is government by rules. Rules are always abstract, while life and facts are always practical. Therefore, “how to apply abstract rules to concrete practice” is the most fundamental problem that should be solved by laws. He denoted the core of solving this problem is how to interpret the laws, namely, the interpretation methods of law (mainly four kinds: literal interpretation, teleological interpretation, systematic interpretation and historical interpretation). Consequently, interpretation methods of law are the core for every law man, which would accompany each law man for a lifetime. Professor Zhang suggested that three things should be done in researching and studying laws: first, turn to find articles of law when faced with problems; “talking in terms of law” is the basic literacy for law man; second, master primary interpretation methods of law, which is emphasized by German law schools and colleges; third, grasp the analytical framework of the case and form a systematic thought.

In the interactive section, Professor Zhang discussed and exchanged the relevant methods and issues on studying and researching laws with teachers and students of HNUC, deepening their understanding on the methods of legal study, and also stimulating students’ interests in legal studies.
