Professor Chen Duanhong of Peking University Came to HNUC to Give an Academic Lecture

On the morning of October 29, Professor Chen Duanhong, the doctoral supervisor of School of Laws at Peking University, and member of Macao Basic Law Committee of the National People’s Congress, gave a special lecture entitled “Constitutional Loyalty” at Moot Court F101 of Lezhi Building. The lecture was hosted by Professor Deng Lianfan, director of Center for Incorrupt Government and Collaborative Innovation. Over 130 scholars, teachers and students in and outside the university attended and listened to the lecture.

At the beginning of the lecture, Professor Chen Duanhong first elaborated the background of constitutional loyalty from the practical significance of loyalty to Constitution. He believed that loyalty is of morality, a noble emotion, and constitutional loyalty is manifested through pledge to Constitution. He further elaborated on what is constitutional loyalty and why constitutional loyalty is needed. Professor Chen pointed out that the premise of constitutional loyalty is loyalty to the nation, loyalty has identity that must be constructed, the nation takes certain identity as the premise, and constitutional loyalty is of great significance for building national identity. National loyalty is loyal to the sovereign that, in the people’s democratic nation, is identical to the people, and the Constitution is the fundamental law of the nation (sovereign). Thus, national loyalty has changed from being loyal to sovereigns to being loyal to the Constitution. Finally, Professor Chen proposed that the Constitution is the civic religion in modern society. The pledge policy is a kind of cultural implant and also the best way to express constitutional loyalty. Constitutional loyalty can not only be viewed, from a negative perspective, as not violating the constitutional norms, but should also from the perspective of consciously implementing the Constitution and actively defending national sovereignty.

In the interactive section, Professor Chen discussed and exchanged the relevant issues on studying and researching the Constitution with teachers and students of HNUC, and had a discussion on how to make citizens create ceremonial sense to the Constitution, and whether it is possible to go up from the obligation of law to the loyalty of law. The heated discussion has deepened the understanding of teachers and students on constitutional loyalty, and also stimulated students’ interests in further constitutional studies.
